FSMI'S REPLIES TO 20 QUESTIONS OF TRAI ON NET NEUTRALITY

Question 1:
Is it too early to establish a regulatory framework for OTT services, since Internet penetration is still evolving, access speeds are generally low and there is limited coverage of high-speed broadband in the country? Or, should some beginning be made now with a regulatory framework that could be adapted to changes in the future? Please comment with justifications.

SOFTWARE PATENTS KILLS INNOVATION

The Free Software Movement of India (FSMI) has alleged that the new Guidelines for Examination of Computer Related Inventions are illogical. It argues that they violate the spirit and law contained in the amended Patents Act of 1970 and could pose a grave threat to innovation in our country.
It cautioned that permitting software patents through the backdoor would severely restrict the innovative capabilities and would adversely impact the creative and entrepreneurial spirit of the youth in the country.

The Free Software Movement of India notes with concern the proposal of the Union Government to bring back (albeit in a different form) the widely misused Section 66A of the IT Act that was struck down by the Supreme Court in a landmark judgment in March 2015.

PRESS STATEMENT ON ABEYANCE OF GUIDELINES FOR EXAMINATION OF COMPUTER RELATED INVENTIONS

The Free Software Movement of India (FSMI) welcomes the decision of the Patent Office, made vide its Order of December 14, 2015, to revoke the Guidelines for Patenting of Computer Related Inventions (CRIs) issued on August 21, 2015.

The Patent Office has stated in its aforementioned order that having received several representations regarding the interpretation and scope of Section 3(k) of Patents Act, it has decided to keep the Guidelines of August 21, 2015, under abeyance till contentious issues are resolved.

FSMI AGAINST AICTE'S DEAL WITH MICROSOFT

FSMI delegation gave a representation to the AICTE appealing for a  revision of AICTE - Microsoft deal by enforcing the usage of Office 365 in all engineering colleges.  This decision is in contrary to the Government of India's policies and against the interest of the Nation.
